Rouse | LEXOLOGY
In August 2, 2020, CJ Villavicencio the winner of The Pop Stage, a local online talent show in the Philippines that was operated by a well-known actor Matteo Guidicelli, was accused of copyright infringement for copying musical arrangements of Eraserheads’ songs without permission. The director of AHEB (Ang Huling El Bimbo: The Musical) was the one who accused such violation towards the champion. During the competition, CJ Villavicencio entered a medley of Pare Ko, Alapaap and Huwag Kang Matakot, which are all Eraserheads songs. Moreover, the director of AHEB also condemned the judges of the talent show for tolerating such violations.
According to The Pop Stage winner, CJ
Villavicencio, his performance was a tribute for Eraserheads and AHEB:
The Musical and that he did not intentionally want to plagiarize the musical
arrangements.

Copyright
infringement is a strict violation towards all who takes advantage of works
that don’t belong to them whether it be a painting, blueprint, idea, or musical
arrangement. Copyright protection is a law and must be respected at all times. Intellectual
property violation is not something people can talk about and forget; it is a
law and no one is above it. If you violate the law, accept the consequences. No
matter what the circumstances are, you still violated the law. Therefore, you
must be penalized accordingly and appropriately. For CJ Villavicencio, regardless of your entry being a
tribute to your favorite musical composers and performers, it doesn’t mean that
you can already use their musical arrangements for how much you like. Besides,
it is unfair for the other contestants who fight fair and square, who goes all
the way asking for permission to use somebody else’s song just to perform a
song. Copyright protection or any form of intellectual property rights was
created not just to prevent someone from illegally using an original work, it was
also created to create equality in the industry.
